Acceptance of Terms
By accessing or using the Aztech Forensics website or engaging our services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our site or services. These terms apply to all visitors, clients, and others who access or use our services.
Description of Services
Aztech Forensics provides professional network design, structured cabling, cybersecurity, server installation, camera installation, access control, audio/video systems, Office 365 migration, managed IT services, and digital forensics services. The scope of any specific engagement is defined in a separate Statement of Work or Service Agreement executed between Aztech Forensics and the client. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.
Prohibited Uses
- Using our website or services for any unlawful purpose or in violation of applicable federal, state, or local laws and regulations.
- Attempting to gain unauthorized access to any portion of our network, systems, or client environments through any means.
- Transmitting or uploading any harmful, malicious, or disruptive code, software, or content through our systems or communications channels.
- Misrepresenting your identity, authority, or affiliation when requesting services, particularly for digital forensics engagements.
- Reproducing, duplicating, copying, or reselling any part of our deliverables, methodologies, or proprietary documentation without explicit written consent.
Client Engagements & Project Scope
All service engagements require a signed Statement of Work or Service Agreement that defines project scope, deliverables, timeline, and pricing. Changes to project scope must be submitted in writing and approved by both parties prior to implementation. Aztech Forensics reserves the right to decline any project request at our discretion. Clients are responsible for providing accurate information and necessary access to complete agreed-upon work.
Payment Terms
Payment terms are specified in each individual engagement agreement. Unless otherwise agreed in writing, invoices are due within 30 days of issuance. Aztech Forensics reserves the right to suspend services for accounts with overdue balances exceeding 30 days. Interest may accrue on past-due balances at the maximum rate permitted by law. Clients are responsible for all applicable taxes associated with services rendered.
Intellectual Property
All content on the Aztech Forensics website — including text, graphics, logos, and documentation — is the property of Aztech Forensics and is protected by applicable copyright and intellectual property laws. Deliverables created specifically for a client under an engagement agreement become the property of that client upon full payment. Aztech Forensics retains the right to use anonymized methodologies, frameworks, and general knowledge gained during engagements for future client work.
Confidentiality
Aztech Forensics treats all client information as confidential. We will not disclose proprietary or sensitive client information to third parties except as required by law, court order, or as expressly authorized by the client in writing. Clients engaging our services agree not to disclose Aztech Forensics' proprietary methodologies, pricing structures, or internal processes to competitors or third parties without prior written consent.
Digital Forensics Engagements
Digital forensics engagements are governed by a separate Forensic Services Agreement that addresses chain-of-custody requirements, evidence handling protocols, expert witness obligations, and case confidentiality. All forensic work is conducted in compliance with applicable federal and state rules of evidence. Clients requesting forensic services represent that they have the lawful authority to authorize the examination of the subject devices, data, and systems. Aztech Forensics will not conduct forensic examinations on devices or data without proper legal authority.
Limitation of Liability
To the maximum extent permitted by applicable law, Aztech Forensics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services or website, even if we have been advised of the possibility of such damages. Our total aggregate liability to any client for claims arising from a specific engagement shall not exceed the total fees paid for that engagement. Some jurisdictions do not allow limitation of certain warranties or liabilities, so these limitations may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Aztech Forensics, its officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of our services in violation of these Terms; (b) your violation of any third-party right, including intellectual property rights; or (c) any claim that your instructions or data caused damage to a third party.
Termination
Either party may terminate a service engagement by providing written notice as specified in the applicable service agreement. Aztech Forensics reserves the right to immediately terminate or suspend access to services if a client violates these Terms of Service, engages in fraudulent activity, or fails to fulfill payment obligations. Upon termination, any outstanding fees for work completed remain due and payable. Sections of these Terms that by their nature should survive termination shall continue in effect.
Governing Law & Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona. You consent to the personal jurisdiction of such courts and waive any objection to the laying of venue there.
Changes to These Terms
Aztech Forensics reserves the right to update or modify these Terms of Service at any time without prior notice. Changes will be effective immediately upon posting to this page with an updated revision date. Your continued use of our website or services after any changes constitutes your acceptance of the revised terms. We encourage you to review these Terms periodically.
